Thank you for visiting SlobberJaws.co by EZRCo Companies LLC (“EZRCo”, “ezrco.com", "SlobberJaws.co", "The Guardian", “we", “us" or "our"). EZRCo strives to create and deliver products and services that improve lives. We believe that good technology can both change life for the better and improve our planet. And while we understand that reading legal terms is not slobberlicious fun, it is important that you read and understand our legal, terms and policies completely, before using our Services. These Terms of Services govern your use of and provide information about “EZRCo” products, services and business (the “Services”), as provided here/below. When you use or access our Services, you agree to these terms.

ARBITRATION NOTICE: YOU AGREE THAT DISPUTES BETWEEN YOU AND US WILL BE RESOLVED THROUGH INDIVIDUAL ARBITRATION AND YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

We agree to provide you with the Services. The Services include all of the products, features, applications, services, technologies (software, hardware, physical, virtual or other), intellectual property and related offerings that we provide.

Providing our Services may require collecting and using your information. The Privacy Policy below explains how we may collect, use, and share information. It also explains ways you may control your information. You must also agree to our Privacy Policy to use “EZRCo”.

Agreement
If you do not agree to these Terms or the Privacy Policy, you must not access or use the Services. These Terms apply to all users of the site and Services, including without limitation users who are browsers, vendors, customers, merchants, content contributors, and/or anyone else who interacts with our apps, sites and/or Services. We reserve the right to update, change or replace any part of these Terms by posting updates and/or changes here or on our sites, apps or Services. It is your responsibility to check this page for changes. Your continued use of or access to the Services following the posting of any changes, constitutes acceptance of those changes.

Certain Services are hosted by Shopify Inc, who provide us with an online e-commerce platform that allows us to sell our products and Services to you. You are also bound to any additional terms and conditions of Shopify.

Online Store Terms
By agreeing to these terms, in return for our commitment to provide the Services, we require you to make the below commitments to us.

Who Can Use “EZRCo”. We want our Products and Services to be as open and inclusive as possible, but we also want it to be safe, secure, and in accordance with the law. So, we need you to commit to appropriate restrictions in order to use our Services.
You must be at least of legal age as defined by your jurisdiction.
You must not be prohibited from receiving any aspect of our Services under applicable laws or engaging in payments related Services if you are on an applicable denied party listing.
We must not have previously disabled your account for violation of law or any of our policies.
How you cannot use EZRCo.
You cannot impersonate others or provide inaccurate information.
If we require an account or login for you, you must provide us with accurate and up to date information. You may not impersonate someone you aren't, and you cannot create an account for someone else unless you have their express written permission.
You cannot do anything unlawful, misleading, or fraudulent or for an illegal or unauthorized purpose.
You cannot violate (or help or encourage others to violate) these Terms or our policies.
You cannot do anything to interfere with or impair the intended operation of the Services.
You cannot use a domain name or URL in your username without our prior written consent.
You may not use our software, apps services and/or products for research of any type and/or publish data, without the prior written consent of EZRCo.
You may not use any of our Services, including our products, for any illegal or unauthorized purpose, in violation of any laws in your jurisdiction (including, but not limited to, intellectual property laws). You must not transmit any code of a destructive nature to or via our Services. A breach or violation of any of the Terms may result in an immediate termination of your use of our Services, and legal action.
All purchases of physical, tangible products are subject to our Shipping and Returns Policies below.

Permissions You Give Us
As part of our agreement, you give us permissions that we need to provide the Services. We do not claim ownership of data and information owned by you, but you grant us the right, under a perpetual zero-cost and royalty-free license (no-cost license), with the right to use and/or grant licenses/sub-licenses without restriction.

Our Additional Rights
If you select a username or similar identifier for your account, we may change it if we believe it is appropriate or necessary (for example, if it infringes someone's intellectual property or impersonates another user).

You may not access or attempt to access, modify, create derivative works of, decompile, or otherwise attempt to extract design, details, materials, formulae, colors, code from us or reverse engineer our services, products, hardware or other technology. If we have used open source software in the development of our product, where we have made improvements to that software, with written request, we will provide you a copy of the open source software source code, object code or any other software, data, models, algorithms, designs, schema and related technology and software/data, as required by the open source license.

Intellectual Property
You agree that the Services provided by us are the property of EZRCo. Your use of Services are governed by these terms, including for Services delivered through and application store such as the App Store, which are governed by the Apple default End-User License Agreement (EULA). Any terms we add by addendum or reference at a later point, are incorporated as part these Terms. Understand that no right, beyond those provided in these Terms, are granted to you or anyone else. Any right granted beyond these would be through separate written agreement between EZRCo and any party.

Disagreements
You agree that any dispute will be resolved through individual arbitration, and that you waive your right to participate in a class action lawsuit. If any aspect of this agreement is unenforceable, the rest will remain in effect to the fullest extent of the law. Any amendment or waiver to our agreement must be in writing and signed by us. If we fail to enforce any aspect of this agreement, it will not constitute a waiver of our rights.

Rights
This agreement does not give rights to you or any third party(ies), except those provided herein these Terms. We reserve all rights not expressly granted to you. You cannot transfer your rights or obligations under this agreement without our consent. Our rights and obligations can be assigned to others. For example, this could occur if our ownership changes (as in a merger, acquisition, or sale of assets) or by law.

Accuracy of Information & Responsibility
We are not responsible if the information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions, without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.

We also don’t control what people and others do or say, and we aren’t responsible for their (or your) actions or conduct (whether online or offline) or content (including unlawful or objectionable content). We also aren’t responsible for services, products and features offered by other people or companies, even if you access them through our Services.

Our responsibility for anything that happens on the Services (our “liability") is limited as much as the law will allow. If there is an issue with our Services, we cannot know what all the possible impacts might be. You agree that we won't be responsible ("liable") for any lost profits, revenues, information, or data, or consequential, special, indirect, exemplary, punitive, or incidental damages arising out of or related to these Terms, even if we know they are possible. This includes when we delete your content, information, or account.

Our Services are provided "as is / where-is,” and we cannot guarantee such Services will be safe and secure or will work all the time or for every customer.

EXCEPT AS PROVIDED HERE, ACCORDING TO THE TERMS OF SALE, TO THE EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Changes to the Services
We reserve the right to make any changes to the Services, at any time and without notice, including that the prices for our products and Services are subject to change without notice. We reserve the right at any time to modify or discontinue the Services (or any part or aspect thereof) without notice, at any time. We shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service (or any product).

Products, Services and Refunds
Certain products or Services may be available exclusively online through this website, or other website(s) of EZRCo. These products or Services may have limited quantities and are subject to return or exchange only according to our returns policy below. We make every effort to display as current and accurate information possible, including colors and images of our products on our store(s). We cannot guarantee that your computers monitor(s) or display(s) will represent the color accurately.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or Services that we offer. Discounts from coupons cannot be used for more than one product purchase. We may cancel orders where a customer has used a coupon on an order of more than one product. All descriptions of product(s), product pricing and/or Services are subject to change at any time without notice, at the sole discretion of EZRCo. We reserve the right to discontinue any product at any time. Any offer for any product or Service made on this site is void where prohibited.

We do not warrant that the quality of any products, Services, information or other material purchased or obtained by you will meet your expectations, fitness for any purpose, or that any errors in the Services will be corrected.

Discount Codes
By using discount codes, you are agreeing to our terms specific to these codes. Discount codes are available only to individuals who have signed-up with a valid email on this website, and who make a purchase through this website. Discount codes are limited to one product purchase, and may be subject to certain eligibility criteria. Discount codes must be entered at the time of purchase/checkout to be applied to your order. We will not apply discount codes to completed purchases. Discount codes are not transferrable and cannot be exchanged for cash or any form of credit. Please read discount codes carefully, as they may have an expiration date, after which they are no longer valid. Discounts are subject to the Terms of Service here, and may be cancelled or discontinued at any time, without notice, at the sole discretion of EZRCo.

Accuracy of Account and Billing Information
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card or payment method, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that in our sole judgement, appear to be placed by product development groups/companies, research companies/entities, dealers, resellers, or distributors/wholesalers.

You agree to provide current, complete and accurate purchase and account information for all purchases made through our store on this website. You agree to promptly update your account and other information, including your email address and credit card numbers, along with expiration dates, so that we can complete your transactions and contact you as needed.

Third Party Products/Services
We may offer access to third-party products, services and/or tools that we neither monitor or have any control or input over. You acknowledge and agree that you are solely responsible for your use of these third-party products and/or tools, and are made available to you "as-is/where-is/as-available" without any warranties, representations, or conditions of any kind and without any endorsement. Limits of Lability
Our aggregate liability arising out of or relating to these Terms will not exceed the greater of $1 or the amount you have paid us in the past six (6) months. You agree to defend (at our request), indemnify and hold us harmless from and against any claims, liabilities, damages, losses, and expenses, including without limitation, reasonable attorney's fees and costs, arising out of or in any way connected with these Terms or your use of the Services. You will cooperate as required by us in the defense of any claim. We reserve the right to assume the exclusive defense and control of any matter, subject to indemnification by you, and you will not in any event settle any claim without our prior written consent.

In no case shall EZR Companies LLC, our businesses, our subsidiaries, our directors, officers, employees, affiliates, agents, contractors, suppliers, Services providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Services or any product, including, but not limited to, any errors or omissions in any content, or any posted, transmitted, or otherwise made available through the Services, even if advised of their possibility. Where state or jurisdictions do not allow the exclusion of limitations of liability for consequential or incidental damages, only in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

Indemnification
You agree to indemnify, defend and hold harmless EZR Companies LLC and any/all parent, subsidiary, affiliate, partner, officer, director, agent, contractor, licensor, Service provider, subcontractor, supplier, employee or anyone else associated with EZRCo, harmless from any claim or demand, including reasonable attorneys' fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

Severability
In the even that any provision of these Terms of Service are found to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be separated from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

Termination
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms of Service are effective for a period of one (1) year, and shall automatically renew unless and until terminated by us, or because you elect to not use our Services for a period of over one (1) year. We may terminate this agreement if in our sole judgement, you fail, or we suspect you have failed, to comply with any term or provision of these Terms of Service, we may also terminate this agreement at any time without notice and you will remain liable for any failure in adhering to the Terms of Service, including all amounts due up to and including the date of termination.

Waiver
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. These Terms of Service and any policies or operating rules posted by us on this site, or other EZRCo sites, or with respect to the Services, constitute the entire agreement and understanding between you and us and govern your use of the Services, superseding any prior or existing agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service). Any ambiguities in the interpretation of these Terms of Service shall not be construed against EZRCo.

Disputes
Disputes will be handled on an individual basis, by and through binding arbitration, as governed by the Federal Arbitration Act.

Venue
The laws of the State of Arizona, to the extent not preempted by or inconsistent with federal law, will govern these Terms and any claim, without regard to conflict of law provisions.

Unsolicited Material.
We always appreciate feedback or other suggestions. Be advised that you grant us a royalty free, worldwide license to use any unsolicited material without any restriction or obligation to compensate you for them, and we are under no obligation to keep them confidential.

We may change our Service, Terms and policies from time to time and without notice.

By registering for and using the Service you consent to the transfer of information to the U.S. or to any other country in which EZRCo, a company in the same group of companies as EZRCo or Service Providers maintain facilities and the use and disclosure of information about you as described in this Privacy Policy.

We use reasonable safeguards to help keep the information collected through the Service secure and take reasonable steps (such as requesting a unique password) to verify your identity before granting you access to your account. However, EZRCo cannot ensure the security of any information you transmit to EZRCo or guarantee that information on the Service may not be accessed, disclosed, altered, or destroyed.

Please help us to protect your information. You are responsible for maintaining the secrecy of your unique password and account information, and for controlling access to emails between you and EZRCo, at all times. We are not responsible for the functionality, privacy, or security measures of any other organization.

EZRCo does not knowingly collect or solicit any information from anyone under the age of 13 or knowingly allow such persons to register for the Service. In the event that we learn that we have collected personal information from a child under age 13 without parental consent, we will delete that information as quickly as possible. We are not responsible for the practices employed by any websites or services linked to or from our Service, including the information or content contained within them. RETURNS POLICY

We strive for happy customers. If you are not satisfied with your purchase, items may be returned or exchanged according to the policy below.

We have a 15-day return policy, which means you have 15 days after receiving your purchase to request a return or exchange.

To be eligible for a return or exchange, purchase(s) must be in the same condition that you received them, unused, with tags, and in their original packaging. Product(s) will require a photo, including a description of the issue. After review and approval, EZRCo will provide instructions on how to return the product to receive a refund or store credit.

To start a return, use the contact form. We will then send you an email requesting information required. If your return is accepted, we will send you a shipping label, with instructions for the return. Product(s) sent to us without first requesting a return will not be accepted. Refunds/credits will be processed within 30 business days of when we receive a return that has been approved.

Please inspect your order upon receipt and contact us immediately if the item is defective or damaged. If you have received the wrong product(s), please also contact us immediately so we can evaluate and make it right.

Unfortunately, we cannot accept returns on gift cards.

In some cases we will provide refunds and in other cases will provide in-store credit, at our sole discretion.

We will notify you if your return is approved, or not. If approved, you will be refunded within 30 business days. Please remember it can take time for the bank or credit card company to process and post the refund. If more than 30 business days have passed since we approved your return, please reach out to us at our contact form.

SHIPPING POLICY

Our goal is to get products to you as quickly possible. We will work to ship orders within 24 hours of being placed during non-holiday business days. Times may vary based on order volume and customers may experience delays in receiving their orders during the holidays, or if we receive a surge of orders beyond our production capacity at that time. We will work diligently and as fast as possible to fulfill your order in a timely manner. If an order has been placed, but not received timely, please use our contact form.

We offer you a choice in shipping options, including expedited shipping through various shippers. Shipping charges, including those for expedited shipping options, will be available at checkout along with rates. We offer free ground shipping on orders over $50 within the continuous USA (excluding HI, AK, Puerto Rico).

We try to reduce shipping material and waste to the extend we can and will use shipping packages that support this goal when possible.

We do not offer international shipping.

If your order is delayed for any reason that we are made aware of, we will work to advise you of revised delivery date. If you do not hear from us and an order is delayed, please use our contact form.

We are closed and do not ship on USA holidays. When carriers are closed, shipping may be delayed.
